Sir need to check whether your mother falls in Audit or not. If she is not in Audit and proprietor then no need to deduct tds.
If she falls in Audit then she needs to deduct TDS from the salary.
I am getting a salary from my mother (a working professional) of 300,000 per year for handling some responsibilities for her. For the last three years. This salary paid to me by her is shown in her return. 300,000 per year. She does not have TAN number, so she is not cutting TDS on my salary from her. But I am paying advance tax (a good sufficient amount) so perhaps there is no need for her to go through the hassles of getting TAN then deducting TDS and depositing TDS return and all that? What do you recommend? I can stop taking this salary if it can create any problems for her. Thank you.

Dear Sir,
If in the previous year, your mother was liable to audit under the income tax act, then she has to deduct your TDS. Otherwise, it is not required.
She requires audit yes. Fed up of these nonsensical laws. We don't want to go through the hassles of getting a TAN number then paying TDS then filing TDS returns and all that headache. What is the maximum that can happen if we let it go on as it is. It's only 300,000 per year. That is 25,000 per month.
Hello Sir,
If she is covered under tax audit, then she is liable to apply for a TAN and deduct Taxes.
In case you want to avoid this then please restrict this amount to Rs.250,000/- i.e the amount not liable for taxes.
Trust this clarifies your query.
Feel free to call back/ get back in case of further clarifications.
Thanking You.
