• Gst on Royalty on books sold abroad

Sir, Who would be liable for GST for Royalty remiited in India for books sold abroad? Domestic Royalties on book sold are GST charged on RCM.

Please let us know whether you are a Publisher or Author?

Assuming you are Author, please let us know who pays you the Royalty for the books sold abroad? Is it Indian Publisher or Foreign publisher?

Hi Hemant

This would be considered as export of services under GST since you would be receiving the remittance in foreign currency.

If you are registered under GST, you can apply for LuT and export such services without payment of GST. If not registered, registration applicability needs to be checked. You need to register for GST if your annual turnover exceeds Rs 20 lacs.

In that case, it would be considered as export of services under GST if you receive the payment in foreign currency and have FIRC for each payment.

Are you registered under GST. If yes, then you should apply for LUT and then you can export such services without payment of IGST. If you don't take LUT, you will have to first pay IGST and then claim refund of it.

If not registered, you need to register for GST if your annual turnover exceeds Rs 20 lacs from export plus domestic services.

Dear Sir,

It will be treated as export of service and you need to obtain GST registration if the threshold crossed RS.20 lacs. Under export there are two.options available, one is export with payment of taxes and second is export without Payment of taxes. For export without payment of taxes, you need to obtain LUT for which application is made online.
