• Two form 16 from different company

Gratuity and leave encashment earned from previous company . Notice period recovered earlier company and reimbursed current company . Wants to know my tax burden and tax calculation .

Dear Sir,

- Gratuity and leave encashment are partly exempt and partly taxable depending upon the calculations.

- Notice period salary will be taxable as profit in lieu of salary.

- Please provide complete details.

From the company it was received it will be included and from the company it was deducted it will be allowed as deduction.

You will need to share further details to ascertain the tax liability. Gratuity and leave encashment will be partly exempt depending on the details you provide. Notice period reimbursement will be fully taxable.

Can you share your service period, salary structure and the nature of the company for which you work so that liability can be ascertained.

Calculations need to be done for taxable and exempt portions of gratuity and leave encashment. Form 16 of both the companies are to be incorporated in the ITR.

Gratuity and levae encashment is exempt from the tax to the extent permissible as per the rules.

Dear Sir, Gratuity is exempt under Se.10(10) of the income tax act. But it is not completely exempted, exemption depends on a calculation which can not be done unless you salary details are provided. So, please provide all the required details.
