Dear sir / madam My brother in law has filed nil returns and the details are as follows 1. salary - Rs 1,20,000/- 2. house rent - Rs 2,40,000/- 3.Agriculture income - Rs -1,20,000/- For house rent he got cess of 30% so income from house rent considered was -Rs 1,68,000/- Since there is no tax for agriculture income total taxable income came to Rs -2,88,000/- Final tax payable was Rs 1,900/- After rebate under section 87A tax payable was - NIL My question is 1) Is nil return filing acceptable or is totally waste to file it ? 2) Is there any mistake in the above filing?

- Tax caculation is correct.
- As your GTI was more than exemption limit so it was obligatory for you to file ITR. It was not waste of time.
- If you could have made any investment under 80 then tax could be saved.

The return should be filed. But please check whether the agriculture income is shown under exempt income.
Nil return has to be filed as the taxable income is more than basic exemption limit. It is not a waste but compulsory to file it.
The above filing is correct.
The Tax computed by you is correct. However the total income of the person is Rs 288000/- which is above the basic exemption limit of Rs. 2,50,000/-. The person is liable to file the return of income as income is exceeding Rs. 2,50,000. The benefit of rebate u/s 87A is only in respect of tax. Hence, Return of income is required to be filed in the above case.

It is always advisable to file returns even if you have no taxes. your computations are correct.
You can show agricultural Income as exempt.

if you income is above max exempted limit then you must file ITR in your case you should file even there is nil tax

As the income exceeds basic exemption limit of Rs.2,50,000 ITR filing has to be done in our opinion.
Although the tax is not payable the return needs to filed.
Based on above :
1. NIL return filing is acceptable and has many benefits and is better than non compliance.
2. There is no mistake in above filing.

As your Taxable income is more than Basic Exemption limit you need to file your Income Tax return and take the benefit of rebate. So, filing of return is compulsory.
