• Quarter 1 salary not shown in Form 16A

My form 16A does not show quarter 1 salary. It only shows quarter 2+3+4 salary i.e. INR 2,76,457/-. Whereas my Form 16B indicates my salary as INR 7,99,516/- (As form 16B considers my total salary of Q1+Q2+Q3+Q4). My quarter 1 salary was more because I worked overseas in Q1 and shifted to India for Q2 to Q4. Whereas my total TDS is shown same in form 16A and 16B i.e. INR 33,240/- (My actual TDS deducted is also INR 33,240/-). Please let me know if I should file my ITR based on Form 16 A or Form 16 B??

Hi,

- Part A of Form 16 shows the total amount of salary paid and corresponding TDS deducted and deposited.

- Part B of Form 16 shows the break-up of total amount of the salary. Company had stared deducted your TDS from Q2 and from Q1.

- You need to show entire salary of Rs.7,99,516 in the ITR and claim corresponding TDS credit.

Hi

TDS would not have been deducted when you worked overseas.

You need to show entire global income in ITR. Consider 799516.

Also, check if any TDS was deducted overseas.

You should file your return as per form 16 B i.e you will have to show entire salary in income tax return.

FORM 16 has two parts, Part A and Part B. Part A has information of the employer & employee, like name & address, PAN and TAN details, period of employment, details of TDS deducted & deposited with the government. Part B includes details of salary paid, other incomes, deductions allowed, tax payable etc.

Hi,

You should file your return based in the actual salary received (I.e. as per form 16 part B).

Please note that if any TDS has been deducted overseas, then you can claim foreign tax credit if that TDS while filing return in India.

Whatever is shown in form 16A or form 16B since you know your actual salary is around 7 lakh you must file ITR as per actual salary and I guess TDS is also not deducted on 276457 it has been deducted on some other amount i.e. something around 599500 which I guess would be 799516 less some deduction and some exempt allowance so kindly show correct salary income because nowadays in income tax penalties are getting worse for showing wrong income.

Dear Sir,

You should file your ITR as per form 16 B.

Also,if any tds was deducted overseas, then you can claim foreign tax credit accordingly.

You will need to disclose entire global salary of Rs.799516 in the ITR. If any TDS has been deducted abroad, you can claim the same while filing tax return in India

Firstly, Form 16A and 16B are not related to TDS on salary.

To answer your concerns, the facts need to be understood in details which also includes are tax residential status for the year. Also, how were you working overseas whether on transfer to other entity or by an Indian entity sending you on project. If taxes are not adequately deducted, the employer himself is at fault. Also, kindly note that if your Q1 income is taxable, you will have interest exposure for failure to pay advance tax.
