• Gift from nephew to uncle

Can a nephew gift his uncle an X amount to his real uncle (father's real brother) without attracting gift tax.
If yes any restriction on amount.

Hi,

 

It is exempt within the limit of INR 50000.

 

However, it is advisable to receive the amount through gift deed.

A nephew can only gift amount less than 50k to his uncle without attracting income tax on it. 

 

As per income tax law, nephew is not a relative for uncle.

A nephew is a non relative as per income tax definition and hence the uncle can only receive upto 50k from any non relative without any tax during an year.

It would be better if the gift is through cheque and with a proper gift deed.

Hello,

 

For uncle, a nephew isn't a relative as per the income tax law. Hence gift only up to Rs. 50,000 will be exempt in such cases.
