• Limit of Rs. 20 lacs surpassed

Hello Friends, I just realized that by raising last 2 invoices of January & February, 2020, my gross income reached Rs.21.50 lacs. I am not GST registered as yet. I won't have any professional income in FY 20-21. What do you suggest I should do. Company who has paid me hasn't yet filed the TDS return for the last quarter.

You should have taken GST registration once you cross the limit of 20 lakh as per the provision of the act.

Hi,

 

In order to be compliant, you are required to get registered under GST and file your gst returns for Jan to March 2021.

 

You can the surrender your GST registration if you don't anticipate any business in future. 

 

I know this sounds little odd but that's the way it is.

General reply is that once your cross the limit of Rs.20 lacs, you need to obtain GST registration and pay taxes.Last date to file TDS return is 31.05.2020.

Limit for Registartion in GST is 40 lacs now. So you may wait for GST Registration.

 

Ask your Company to file the TDS Return as they would have to pay penalty on per day basis for late filing of TDS return.

The GST threshold is now increased to INR 40 Million (In case of Goods supplier).

If you are not a supplier of goods then GST will be applicable.

 

However, you can account your Feb and March invoices in April 2020. But that may be considered as Tax evasion, so risky.
