Hi 
I am buying property.

If multiple installments are being paid by a buyer to same seller in same month: 

1. Is it required to fill multiple returns (Form 26QB) 

2. If not, what is the payment/credit date to be mentioned in the return form?

Hello,

Only one form needs to be submitted if multiple payments are made in same month with effective payment date being month end date. Due date is 30 days from end of month in which payments is being made.

The TDS on the immovable property has to be paid using Form 26QB within 30 days from the end of the month in which TDS was deducted.

- As per Income tax rules, TDS should be deducted and deposited on each installment. If it is a purchase of ready to move in property and multiple payments are spread in two to three months then you can deposit it in one lumpsum. Date of payment/credit can be date of last installment which is generally date of registration of the property. If it is a construction of property then TDS should be deducted and deposited on each installment.

 

- Due date of Form 26QB is 30 days from the end of the month in which TDS was deducted.

 

- Rate of TDS is 1% and not 0.75%.

Practically, you can file cumulatively for all payments made in a month. Mention the first date of payment.

You need to file 26QB within 30 days from end of the month in which payment is made.

 

Since you will be making payments spread over the next 1 year, you need to file separate 26QB forms for different months.

No Sir. TDS should be deducted on each payment and Form 26QB should be filed for each payment. The reason is government will not get the TDS amount timely. If you file one Form 26QB and construction will take more than one financial year then govt. will get the whole TDS amount at the time of completion of the construction which will be after substantial delay. Secondly builder will recognise revenue in his books in respect to payments made by you to him in the year of payment and tax will be paid by him accordingly on such revenue in the same financial year then there is no question of filing single Form 26QB.

 

- Interest for non-deduction and non-deposit of TDS is 1.5% per month

- Late fees for late filing of Form 26QB is be Rs. 200 per day. Late fees is levied maximum upto tax amount.

You can file 1 Form 26Qb for entire month.

As it needs to be filed within 30 days from end of month in which TDS deducted.
