• TDS on Unconstructed Property

Below are the details i need to fill for my Form 26 QB 

1. Total Value of Consideration ( Property of Value)
-- Should this value include GST or without GST while mentioning in form 26QB

2. Total Amount Paid/Credited in Previous Installments if any 
Suppose say in previous installment was Rs 55,54,528 including 5% GST (Rs2,64,501) i.e = Rs2,64,501 + Rs52,90,027 which is total Rs 55,54,528
Say I pay 1% TDS on Rs52,90,027 = Rs 52,900

Now for total amout paid/credited previously what should i mention my form 26QB , is it without GST (i.e Rs Rs52,90,027) or with GST (i.e Rs 55,54,528)

3. Total Amount Paid/Credited Currently
Similarly for amount paid/currently should it be with or without

4. Total Stamp Duty Value of the property
Since this is not my last installment what should we fill for this

D. Amount on which TDS to be deducted
And for this amount will be without GST ?

  • Total Value of Consideration (Property Value):


    • Without GST: The value you mention in Form 26QB should be the property value excluding GST.

  • Total Amount Paid/Credited in Previous Installments:


    • Without GST: You should mention the amount excluding GST. In your case, it would be ₹52,90,027, not ₹55,54,528.

  • Total Amount Paid/Credited Currently:


    • Without GST: Similar to previous installments, this should be the amount excluding GST.

  • Total Stamp Duty Value of the Property:

    • If this is not your final installment, you should still provide the current stamp duty value as applicable at the time of filling out the form. This value usually doesn't change with installments, but consult your property agreement or legal advisor if unsure.

  • Amount on which TDS is to be Deducted:


    • Without GST: TDS should be calculated on the property value excluding GST. So, in your example, TDS is deducted on ₹52,90,027, not on the total including GST.

4. Required at the time of last installment. SDV is value on which stamp duty is paid/payable. In your case, assuming sale consideration is more than the guidance vale/circle rate of the property then the amount of sale consideration would be the SDV
