• My Gst is cancelled due to inactivity

Due to my laziness, I had zero filings and kept holding it for one year. They sent me a warning and asked for KYC. After completing KYC, I couldn't restore my GST.
Can I register for a new GST, or can I revoke the old GST? Please help.

If your GST was canceled by the department, you can apply for revocation within 90 days by filing all pending returns and clearing dues including penalties and interest.

If 90 days have passed, apply for a new GST registration.

First you need to check the date of cancellation of GST.

If it is cancelled by GST Officer , You can apply for Revocation of GST within 90 days from the date of cancellation.

Further after filling Revocation application If your Revocation application is rejected by GST officer, we can also file Appeal  against Rejection order within three months from the date of Rejection order. This three months period of Appeal can be extended by one month for genuine reason.

You have to file all the pending returns along with tax, interest & late Fee.

Can advise better on whether to file Revocation application or go for applying  new GSTIN on the basis of sharing complete information.

  • Assess Eligibility for Revocation: Determine if you're within the permissible time frame to apply for revocation of the cancellation.

  • File Pending Returns: Ensure all outstanding GST returns are filed promptly.

  • Settle Outstanding Dues: Pay any pending taxes, interest, penalties, and late fees.

  • Submit Revocation Application: If eligible, apply for revocation using Form GST REG-21 on the GST portal.

  • Consider New Registration: If revocation isn't feasible or is denied, proceed with applying for a new GST registration.

Applying for a New GST Registration:

If the revocation period has lapsed or if your application for revocation is denied, you have the option to apply for a new GST registration. It's important to note that tax authorities may scrutinize new registration applications, especially if a previous registration was cancelled due to non-compliance. They may assess whether the issues leading to the prior cancellation have been resolved before approving a new registration.
