• Tax is payable if person got a salary n pension money via court

Respected Sir,
                            My father is ex army man. He won the Promotion case after 32 years against govt. Of India and his Regiment Jat centre bareilly. Arms force tribunal lucknow declare the judgement in his favour n order is passed to release the salary of period from 1983 Dec to 1988 Dec for the rank of Nb/Sub and 9% interest on salary amount annualy  upto 2015 dec. Secondly from 1989 to 2015 dec pension should be release  along with 9% interest annually. So its to assumed that amount which my father got is more tha 50 lakh . Is this amount comes under income tax or its exempted because amount was hold with govt. Tax is payable on whole amount n how it be remburse.

The salary amount and pension is taxable , but you can claim spread over of back salary in previous years income and recompute tax under section 89 and claim rebate of difference between tax on receipt basis and accrual basis and such rebate is deducted from tax payable for current year.

The total amount is taxable, but you can calculate the same with regard to Section 89 which deals with salary received in arrears and get some benefit.
