• I want to know whether I need to register GST for my business

I am a software freelancer. I directly serve all my clients in abroad. I use to get my payment using PayPal. Although I am aware of that export is tax free. And my business supports every criteria prescribed for export. I invoice my clients in foreign exchanges like dollar and euro depends on the country they belong to. Also what if I would keep doing my business using sites like www.freelancer.com. As I could not find any provision of deducting GST on their site while I am charging my clients from both abroad and domestic(domestics are only served using freelancer website not directly although those clients can be from different states but right now after GST has come into play serving domestic clients is on hold) market. Do I need to register myself in GST?

Hi,

Basically, there is no clarity on this subject. Both the views are there .

Safest view, since exports are interstate supply, you need is to register in GST and comply with the requirements.

Aggressive view is since exports are exempt supply, you don't need to register.

We are advising our clients to register on GST.

For domestic clients, yes, registration would be required.

For export of services, the issue is debatable. A clarification in this regard is expected soon. Right now, we are advising our clients to take GST registration.

Yes You have to Register under GST coz Export of services/goods are inter state supply under GST as ZERO RATES SUPPLY , thus in your case you have to register and have to option either fill LUT/BOND with department and export without payment of IGST or first pay IGST and claim refund.

You can register under GST and obtain GSTN. For proprietorships, there is no requirement for submitting the registration document, as the proprietor and proprietorship are considered the same legal entity.

in GST Trade License is not mandatory and in your case you can run this business from your home also,

thus apply for GST and start doing compliance to avoid litigation.

Hello,

Having a local trade license is not mandatory under GST. You can directly apply for a GST registration under the trade name of your choice. All you need to have is a bank account with that name.

In order to be registered under GST, it is not mandatory to have a trade license. You can apply for a GST License without the same.
