• Service tax liability on teachers teaching in coaching institutes

Dear  Sir, 
I am teaching in a coaching institute which is duly paying the service tax collected from the students. I have receipts above 10 lacs in a year. Will I have to pay service tax separately. If yes how do I do the compliance for this complete year and the last year.

Hi,

In case you are an employee of the institution there will be no service tax liability on your part. However, if you are visiting lecturer and working independently you need to register with service tax dept. and collect service tax accordingly.

Dear Sir,

Yes you need to pay service tax separately because you are providing service to the institute. While student are providing service tax on the fees charges by coaching institute.

So once your income crosses rs. 9 Lacs you need to take registration and pay service tax once it crosses Rs. 10 Lacs. You will also need to file six monthly return for the same.

Dear Sir,

The applicability of Service tax totally depends on the nature in which you are receiving funds.

If it is in the nature of salary, then Service Tax does not apply.

But if it is in the nature of professional fees, then you will need to register yourself as you cross 9 Lacs and start charging service tax as soon as you cross Rs.10 Lacs.
